of Use.
These Terms of Service are applicable to the sales between the persons making a
purchase (hereinafter referred to as “You” or the “Customer”), and JA.LIZAH
(hereinafter referred to as “We”, “Us” or “JA.LIZAH”). The sale of products is thus
subject to acceptance of and respect for these Terms and Conditions. By
completing payment, you automatically agree to accept these Terms and
Conditions of Sale.
The photographs accompanying the items on our Site are given for illustrative
purposes, and only the technical description of the product is legally binding.
In particular, we draw your attention to the fact that the images shown on the site
and the colours composing them depend on the screen and computer systems
used. The colour shades may therefore vary. If you have any questions regarding
the products, we invite you to contact us directly.
The products offered on the Site are exclusively intended to be sold to end
consumers, private individuals or corporate entities, to the exclusion of any resellers
or intermediaries acting on behalf of resellers. Consequently, the Customer declares

that (s)he is acting as end consumer and does not intend to resell the artefacts
purchased for commercial purposes.
To be able to make a purchase you must fulfil the following conditions:
(i) Have reached the legal age of majority in your country;
(ii) Have legal capacity to contract;
In making your purchase, you declare and confirm that you are acting as consumer,
on a non-commercial basis, are an adult and have full legal capacity enabling you to
contract with us.
JA.LIZAH reserves the right to refuse any clearly disproportionate order, the
quantities of which appear abnormal for a consumer or appear to characterise a
professional order made for commercial purposes.
All orders are subject to acceptance and availability. We will gather and process the
Customer’s contact and order details. The Customer will receive a notification when
the order is out for delivery.
For all customized orders a payment of 50% is necessary for the order to fully be
processed. The payment of the other 50% has to be fulfilled upon delivery.
JA.LIZAH reserves ownership of the order until it has received the full price of the
order. JA.LIZAH reserves the right to cancel or refuse any order from a Customer,
subject to the existence of a legitimate reason.
In particular, JA.LIZAH reserves the right to refuse or cancel any order it deems to
be fraudulent, or submitted by a Customer not having honoured a previous order.
Products are billed at the rate in force at the time of confirmation of the order on
the Site by the Customer. Unless indicated otherwise, all prices mentioned on the
Site are given inclusive of VAT, to the exclusion of any other tax that may apply and
excluding delivery costs.
These taxes and delivery costs may change according to the content of your order
and your chosen place of delivery.
The amount of the delivery costs will be specified during the ordering process and
before its confirmation.
You can pay for your purchases on the Site using one of the following methods:
- Payment by bank card: Visa, Mastercard, American Express

- Payment via iDEAL, PayPal and Apple Pay
For the security of its Customers and the transactions made on the Site, JA.LIZAH
reserves the right to verify the data communicated by the Customer in order to
ensure it is the holder of the bank account to be debited.
This verification may take the form of a request for proof of identity and/or address
and/or banking documents (RIB or cancelled cheque).
Absence of response from the Customer to a request of this type within the
timeframe given by JA.LIZAH will entail cancellation of the order in question,
without any possibility of later claim.
JA.LIZAH also reserves the right to cancel any order that presents one or more risk
factors for fraudulent use of a bank card.
When we have received your order, we strive to get your package to you as soon as
possible. If the item that you have ordered is in stock, it will be dispatched from our
warehouse within 24 hours (on working days).
If you live in the Netherlands, we strive to deliver your package to you within 2
working days. If you live in the EU, we strive to deliver your package to you within 4-
8 working days. For information about delivery times in other parts of the world,

Estimated delivery times are to be used as a guide only and commence from the
date of dispatch, JA.LIZAH is not responsible for any delays caused by destination
customs clearance processes or problems with the postorder companies.
When you place an order at the Site we will send you an email with the tracking
number on the day your package will be dispatched. You can check the status of
your shipment using the tracking number.
In case your order has been shipped:
At the time of the receipt of your order, it is important to check the condition of the
parcel and the conformity of the content in the presence of the carrier, so as to
make any reservation concerning obvious defects (parcel damaged or open, item
missing or defective, etc.).
Furthermore, any anomaly concerning the items (damage, missing item in relation

to order, parcel damaged or open, item broken, defective, etc.) should imperatively
be reported to JA.LIZAH within one day of receipt.
Any risk of loss or damage to the items is transferred to you at the time you or a
third party you have designated, and other than the carrier we proposed, physically
take possession of the items.
Any customs or import duties are charged once the parcel reaches its destination
country. These charges must be paid by the recipient of the parcel (this also applies
to retail & wholesale customers). Unfortunately, we have no control over these
charges, and cannot inform you what the cost would be, as customs policies and
import duties vary widely from country to country. It might be a good idea to
contact your local customs office for current charges before ordering, to not be
surprised by unexpected charges.
Orders cannot be cancelled or returned after the order has been paid and
processed.
JA.LIZAH provides a 2-year warranty on artefacts purchased from JA.LIZAH. This
warranty covers manufacturers defects in material or workmanship. It does not cover
neglect or abuse (see below). The periodic inspection of your artefact purchase is
the best way to safeguard against potential problems. Regular upkeep of your
artefact is required to maintain your warranty. This includes paying for any normal
repairs required due to wear, damage, or abuse.
The warranty does NOT cover the following items:
(i) Any damage to your artefact purchases due to negligence or abuse. (For
Example: If a stone is lost due to bent, damaged, or worn-out prongs, JA.LIZAH is
not responsible for the replacement of the stone or the re-tipping of the prongs. If
the jewellery was neglected and abused and the warranty becomes void.);
(ii) If another jeweller performs any repair work on an item purchased from
JA.LIZAH, we will not be held responsible for any loss or defect and the warranty
becomes null and void;
(iii) The loss of diamonds is not covered under the warranty;
The Site and all its elements (including but not limited to trademarks, texts,
drawings, images, videos, animation, logos, icons, sound recordings, documents to
download, interfaces, coding, software) are the exclusive property of JA.LIZAH and
are protected by the provisions of the Code of Intellectual Property and international conventions applicable to intellectual property rights.
Any reproduction, representation, adaptation, total or partial and any download and
transfer, on all media of all or part of this content, for purposes other than for
private and personal use for a non-commercial purpose of the user is strictly
prohibited without the prior written consent of JA.LIZAH and any other rights
holders.
Within the framework of an order, we will need to process your personal data.
JA.LIZAH attaches great importance to the protection of your personal data. In this
Privacy Policy we aim to provide clear and transparent information about how we
handle personal data. We make an effort to safeguard your privacy and therefore
handle personal data with care.
- We process your personal data in accordance with the purpose for which they
were provided, these purposes and type of personal data are described in this
Privacy Policy;
- The processing of your personal data is limited to only those data that are
minimally required for the purposes for which they are being processed;
- We do not pass on your personal data to other parties, unless this is necessary for
carrying out the purposes for which they were provided;
